The political parties opposing the immediate three divorced legislation are not ready to understand this simple fact that there are some such things which have to be resorted to by law to stop them.
To stop the evil of three divorces immediately, the Muslim women’s marriage rights presidency bill introduced in the Lok Sabha is not surprised at the opposition of some other parties including the Congress, JD-U. These parties had already made it clear that they would like to go on the path of opposition to this issue. The party opposing the immediate three divorced legislation is arguing that why law is being used to stop a social evil? It is therefore a hollow argument that not only in India but many other countries have resorted to law to ban social evils. Are not laws made on dowry and child marriage?
I do not know why the political parties opposing the immediate three divorced legislation are not ready to understand this simple fact that there are some such things that have to resort to the law to stop them. These political parties should be familiar with the fact that even after the Supreme Court has imposed three immediate instances of divorce, there is a continuation of divorce in this manner. Is this information given by Law Minister Ravi Shankar Prasad, presenting the Muslim Women’s Marriage Rights Protection Bill in the Lok Sabha, is not surprising, after the Supreme Court’s decision, 229 cases of divorce were reported in one stroke? Does it challenge the rule of law with the court’s contempt?
Worrying is not only that the decision of the Supreme Court is not being taken care of, but it is also that the divorce was done in the same way after the ordinance which immediately commuted the three offenses, which is a criminal offense. According to one figure, 31 cases of divorcing have been revealed in one stroke after the said ordinance. It is clear that after such data, the argument is not too strong that there is a decline in cases of divorce and divorce in divorce cases. It can not be overlooked that there are many Muslim organizations who did not consider the three divorces immediately to be convinced of the Quran, but it was also seeking that the Supreme Court and the government should not interfere in this matter. This is probably the reason why even after the Supreme Court’s decision, the issue of divorce is not there. When the society does not seem committed to ending any social evil, then the government has no choice other than to resort to punitive measures. The government has done this by bringing Muslim Women’s Marriage Rights Protection Bill. Can the team opposing this Bill recommend such a remedy, to prevent this social evil without the law of penal provisions? It is better to understand that they are making the same mistake on their side which was done by the Rajiv Gandhi government in Shah Bano case.
